Introduction

Thank you for using the Members Area (“Members Area”). The “Members Area” refers to the content (including but not limited to online courses, graphics, user interface, audio clips, video clips, editorial content, and the scripts and software) on the pages designated as under the subdomain of “https://www.liveyourmark.com/members-content/” and “https://www.liveyourmark.com/members-area/” on the website www.liveyourmark.com.

The terms of this agreement governs the usage of Members Area of Live Your Mark Pte Ltd (“LYM”).

Your use of the Members Area requires that you agree to the following terms. Please read them carefully. If you do not understand the Terms, or do not accept any part of them, then you should not use the Member Area.

Your Account

As a user of the Members Area, you will need to establish an account (“Account”). Do not reveal your Account information to anyone else. You are solely responsible for maintaining the confidentiality and security of your Account, and for all activities that occur on or through your Account, and you agree to immediately notify LYM of any security breach of your Account. LYM shall not be responsible for any losses arising out of the unauthorized use of your Account.

You agree to provide accurate and complete information when you register with, and as you use, the Members Area (“Members Area”), and you agree to update your Members Area Registration Data to keep it accurate and complete. You agree that LYM may store and use the Members Area Registration Data you provide for use in maintaining and billing fees to your Account.

Unauthorised Access to Accounts. You must keep your user details secure and must not share them with anyone else. You must not collect or harvest any personal data of any user of the online shop or of any user of other LYM Services via the Members Area, including account names.

Disabled Accounts. If LYM disables access to your account in accordance with the Terms (for example if you violate the Terms), you may be prevented from accessing the Members Area, your account details or any files or other Content that is stored with your account.

Information about You. In order to access certain services or Content on the Members Area, you may be required to provide information about yourself such as your name, address, and billing details. LYM’s privacy policies explain how we treat your personal data and protect your privacy when using the online shop. Any such information you provide to LYM must always be accurate, correct and up to date. LYM may need to provide your personal information, such as your name and email address, to Providers for the purposes of processing your transactions and/or provisioning Content to you.

Content

Free Content. LYM may allow you to download or use Content free of charge. Any terms and conditions that apply to purchased Content will apply to free Content, except with respect to payment-related matters (for example, the refund-related provisions of these terms do not apply to such free Content). LYM may impose limitations on your access and use of certain free Content.

Removal or Unavailability of Content. Subject to the Terms, Content that you purchase will be available to you through the Online Shop for the period selected by you. In certain cases (for example, if LYM discontinues a service or Content is discontinued), LYM may remove from your Device or cease providing you with access to certain Content that you have purchased. LYM will provide you with reasonable prior notice of any such removal or cessation. If you are not able to download a copy of the Content before such removal or cessation, then LYM will offer you either (a) a replacement of the Content if possible or (b) a refund of the price of the Content. If LYM issues you a refund, the refund of your purchase price shall be your sole remedy.

Content Availability

LYM reserves the right to change content options (including eligibility and access periods for particular features) without notice and at our sole discretion..

Select, Copy and Paste. Select, copy and paste functions may be available for some text-based Content, and you must use these features within the prescribed limits and only for your sole personal non-commercial purposes.

Members Area access period. The members area is available for access for different periods depending on the content that you purchase.

Access to “TruSelf Creation Course” graduate content is available for up to 3 years from the date of registration of “TruSelf Creation Course” OR 1 Jan 2020 (3 years from launch date of the “Members Area”), whichever is later.

Access to “Instructorship Program” content is available for up to 1 year from the date of registration of “Instructorship Program” OR 1 Jan 2018 (1 year from launch date of the “Members Area”), whichever is later.

Should you require access to your member content for a longer period of time, please write to us here and cases will be evaluated on a case by case basis.

Use of Content (Usage Rules)

LYM reserves the right to modify the Usage Rules at any time. You agree not to violate, circumvent, reverse-engineer, decompile, disassemble, or otherwise tamper with any of the security technology related to such Usage Rules for any reason—or to attempt or assist another person to do so. Usage Rules may be controlled and monitored by LYM for compliance purposes, and LYM reserves the right to enforce the Usage Rules without notice to you.

You shall be authorized to use content on the Members Area only for your sole personal, noncommercial use.

Intellectual Property

You agree that the Online Shop contains proprietary information and material that is owned by LYM and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the Online Shop in compliance with this Agreement. No portion of the Online Shop may be reproduced in any form or by any means, except as expressly permitted in these terms. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Online Shop in any manner, and you shall not exploit the Online Shop in any unauthorized way whatsoever, including, but not limited to, by trespass or burdening network capacity.

Changes to these Terms

If the Terms change, you will be informed of the new terms before you next purchase Content. If you accept the new terms, they will apply to your use of all Content (including Content you have purchased in the past) and all subsequent purchases, until we notify you of further changes.

If you refuse to accept the updated terms then you will not be able to buy any further Content through the online shop, and the latest version of the Terms that you accepted will continue to apply to your use of Content. In this case we will, if we are able to do so, give you a reasonable period of time in which to view the Content on your Devices in accordance with the last version of the Terms that you accepted.

After that time has expired, you will not be given a further opportunity to view the Content you have previously bought and it is possible that you will no longer be able to use the Members Area to access or use the Content you have already bought or related support services.
